It is proposed to consider present-day physics as dealing with a special situation, the situation in which the phenomena of life and consciousness play no role. It is pointed out that physical theory has often dealt, in the past, with similarly special situations. Planetary theory neglects all but gravitational forces, macroscopic physics neglects fluctuations due to the atomic structure of matter, nuclear physics disregards weak and gravitational interactions. In some of these cases, physicists were well aware of dealing with special (...) situations, or limiting cases as they are called in the article; in other cases, they were not. It is pointed out that, even if it were true that present-day physics accurately describes the motion of the physical constituents of living bodies, it would not give the whole story. Arguments are adduced, however, to show that the laws of physics, applicable for inanimate matter, will have to be modified when dealing with the more general situation in which life and consciousness play significant roles. This short essay summarizes an understanding of the trial as a medium in which law is realized or actualized, rather than imposed or enforced. It suggests that we should pay close attention to the actual practices that prevail at trial, its "consciously structured hybrid" of languages and practices, if we want to understand the nature of law.

What do human beings use conditional reasoning for? A psychological consequence of counterfactual conditional reasoning is emotional experience, in particular, regret and relief. Adults’ thoughts about what might have been influence their evaluations of reality. We discuss recent psychological experiments that chart the relationship between children’s ability to engage in conditional reasoning and their experience of counterfactual emotions. Relative to conditional reasoning, counterfactual emotions are late developing. This suggests that children need not only competence in conditional reasoning, but also to (...) engage in this thinking spontaneously. Developments in domain general cognitive processing (the executive functions) allow children to develop from conditional reasoning to reasoning with counterfactual content and, eventually, to experiencing counterfactual emotions. Human languages typically employ a variety of spatial metaphors for time (e.g., “I'm looking forward to the weekend”). The metaphorical grounding of time in space is also evident in gesture. The gestures that are performed when talking about time bolster the view that people sometimes think about regions of time as if they were locations in space. However, almost nothing is known about the development of metaphorical gestures for time, despite keen interest in the origins of space–time metaphors. In this (...) study, we examined the gestures that English‐speaking 6‐to‐7‐year‐olds, 9‐to‐11‐year‐olds, 13‐to‐15‐year‐olds, and adults produced when talking about time. Participants were asked to explain the difference between pairs of temporal adverbs (e.g., “tomorrow” versus “yesterday”) and to use their hands while doing so. There was a gradual increase across age groups in the propensity to produce spatial metaphorical gestures when talking about time. However, even a substantial majority of 6‐to‐7‐year‐old children produced a spatial gesture on at least one occasion. Overall, participants produced fewer gestures in the sagittal (front‐back) axis than in the lateral (left‐right) axis, and this was particularly true for the youngest children and adolescents. Gestures that were incongruent with the prevailing norms of space–time mappings among English speakers (leftward and backward for past; rightward and forward for future) gradually decreased with increasing age. This was true for both the lateral and sagittal axis. This study highlights the importance of metaphoricity in children's understanding of time. It also suggests that, by 6 to 7 years of age, culturally determined representations of time have a strong influence on children's spatial metaphorical gestures. (shrink)

Programmatic concepts have elements that point in a valued direction or name a desired goal. We provide a detailed analysis of the nature of programmatic concepts and cite examples of the programmatic elements found in conceptions of scientific literacy. Next we describe what values underlie these elements and what theories of value might be brought to bear in assessing them. We present an analysis of approximately 70 conceptions of scientific literacy found in the literature since the year 2000. We identify (...) the goals that each of these conceptions of scientific literacy implies and uncover the programmatic elements that are used to justify these goals. Our purpose is to present a sufficiently wide range of views to have a good representation of goals and programmatic elements. Third, we point to a number of pitfalls in any attempt to make preferential selections among the programmatic elements of conceptions of scientific literacy. (shrink)

As the expansion of the Internet and the digital formatting of all kinds of creative works move us further into the information age, intellectual property issues have become paramount. Computer programs costing thousands of research dollars are now copied in an instant. People who would recoil at the thought of stealing cars, computers, or VCRs regularly steal software or copy their favorite music from a friend's CD. Since the Web has no national boundaries, these issues are international concerns. The contributors-philosophers, (...) legal theorists, and business scholars, among others-address questions such as: Can abstract ideas be owned? How does the violation of intellectual property rights compare to the violation of physical property rights? Can computer software and other digital information be protected? And how should legal systems accommodate the ownership of intellectual property in an information age? In his 1993 book, Hare asks “What Makes a Good Teacher?” In this paper we ask, “What makes a good education researcher?” We begin our discussion with Richard Rudner's classic 1953 essay, The Scientist Qua Scientist Makes Value Judgments, which confronted science with the internal subjectivity it had long ignored. Rudner's bold claim that scientists do make value judgments as scientists called attention to the very foundations of scientific conduct. In an era of institutional research ethics, like the Tri-Council’s ethics (...) policy, Rudner's call for an approach to these value judgments is even more relevant. The contemporary education researcher primarily engages with ethics procedurally, which provides a certain level of consistency and objectivity. This approach has its roots in principle-based theories of ethics that have long been dominant in Western universities. We argue that calls, like Rudner's, for an objective science of ethics, are at the root of this dominant institutional approach. This paper critiques the suitability of such principle-based ethics for solving Rudner's concerns, and posits that educational research ethics is better understood as a matter of character and virtue. We argue that, much like the ethical teacher, the ethical education researcher is a certain kind of person. (shrink)

Abstract:The lack of extant contemporary comparanda obscures the workings of iambic trimeter in Senecan tragedy. This article offers a quantitative analysis of the reception of Senecan trimeter in four early works of Italian Humanist Tragedy, which illuminates the creative possibilities afforded by the basic structure of the meter and identifies specific features important to questions of style and semantics. Our analysis demonstrates, among other things, that both Seneca and the Humanist tragedians use clusters of resolution in conjunction with antilabe as (...) a literary device to convey high emotion.
